An Urgency ordinance to control marijuana grows in Nevada County was put on hold by the Nevada County Board of Supervisors yesterday as it became clear it did not have the 4 votes needed to pass. Nearly 300 people packed the public hearing on the new ordinance that as presented, would require medical marijuana growers to register with the county, and would limit the size of gardens, require setbacks from property lines and require fencing. No grows would be allowed inside homes but 6 plants could be grown in outbuildings. Sheriff Royal wanted to have the nuisance abatement ordinance in place before grow season but Board Chair Ted Owens sensed Supervisors Hank Weston and Terry Lamphier did not see the urgency in the urgency ordinance.

As the meeting was approaching 6 hours Sheriff Keith Royal suggested maybe it would be in everyone’s interest to hold off on the emergency ordinance.

The ordinance will be taken up again on May 8th to allow time to engage more citizens in what the regulations will be. County Counsel Alison Barratt-Green made it clear there is no Grace Period.

In two weeks there will be a second reading of the ordinance and it would be 30 days before it would take effect.
