Nevada County District Attorney Cliff Newell says the case was handed over to his office and the nature of the crime was filing false documents for calculation of child support in family court. Initially Somervill was charged with one count of perjury under oath, one count of attempt to file a false or forged instrument and one count of forgery.

Somervill plead no contest to the charge of forgery as a felony and was sentenced to 120 days in jail, 5 years probation, and ordered to pay restitution of just over 2,000 dollars. Judge Candice Heidelberger did not agree to reduce the jail time to 90 days after the District Attorney argued against a reduction of the sentence.

Sumervill can apply for alternative sentencing and Newell says if Somervill successfully completes probation he could file to have the charge reduced under the recently passed Prop 47.
